A psychiatrist may be subpoenaed to testify either as a fact witness or as an expert witness. A fact witness simply states his direct observations while an expert witness is a person who has facts directly related to some science or profession that is beyond the average layperson's scope of knowledge. The psychiatric expert witness should be well-prepared for testimony and cognizance of the judical process, rights and responsibility of the witness.
